Resumen

 

Hoy en día la energía se ha convertido en una materia relevante en diversos ámbitos, que se abarcan desde el medio ambiente a la economía. En este sentido, no se puede separar la energía del derecho. El derecho de la energía ha experimentado, como en aquellos otros ámbitos relacionados con ésta, un desarrollo acelerado y profundo. El objetivo de la liberalización del mercado energético en Turquía se marca con la Ley aprobada en Julio de 2001. El concepto de derecho de la energía puede definirse, de manera resumida, como el sistema legal que viene a delimitar las políticas energéticas concretas en un país. El derecho de la energía es el compendio de principios en torno a la distribución de los derechos y deberes existentes entre las personas individuales; entre las personas individuales, la administración y las instituciones; y entre las instituciones y los Estados que hacen uso de los recursos energéticos. En las condiciones actuales, a pesar de la falta de recursos energéticos otro tema relevante es el de la seguridad energética. La seguridad energética en el contexto internacional es tan importante como en el nacional. En el año 2008 el derecho turco ha desarrollado nuevas regulaciones para suplir las deficiencias existentes en materia de seguridad energética. Esta regulación ha perfilado la definición de las obligaciones en el campo de la seguridad energética al exponer obligaciones nuevas e importantes para los diferentes actores en el mercado de la energía.

ABSTRACT:

 

Today energy has become an important concept in a variety of spheres from environment to economy. In that regard it is not possible to think about law separately from energy. As in the spheres that are related to energy, the energy law also has experienced rapid and dense changes and developments. With a law that was passed in July 2001, the aim is to liberalize the energy market in Turkey.  In short, the concept of energy law can be defined as the legal system concerning the concrete realization of energy policies of a country. Energy law can be regarded as the total of principles regarding the distribution of rights and duties that exist among individual persons, between individuals and administration and institutions, and between institutions and states that aim at utilizing the energy resources. In today’s conditions, besides the paucity of energy resources, the other important issue is the energy security. The energy security in the international context is as significant as it is in the national context. In 2008, new legal regulations have been carried out in the Turkish law to cope with the deficiencies of the existing regulations about energy security. With this regulation, by bringing new and important duties to all actors of energy market, new duty definitions about energy security have been made.
