La ausencia de una posibilidad legal para los jueces encargados del Registro Civil de eximirse de estos procedimientos, ha planteado casos de objeción de conciencia. Tribunal Europeo de Derechos Humanos.</p> <p><strong><tt>Abstract</tt></strong></p> <p><tt></tt>The Spanish legal reform that opened the door to same-sex marriages has generated a debate that is not yet closed. The heterosexual nature of marriage remains as a central aspect, without which this institution loses its meaning. The absence of a legal possibility for the judges of the Civil Registry the possibility of being exempted from performing these ceremonies, have raised some cases of conscientious objection. One of these cases has been recently decided by the Supreme Court, which denied the possibility of alleging objection because our legislation does not expressly foresee it, either in general terms or with specific reference to this case. European Court of Human Rights recognizes that there is still no consensus in recognizing such unions and cannot be enforced same-sex marriage. </p> <p><tt><strong>Keywords:</strong></tt><tt> </tt>Same-sex marriage.
