The attribution of the use of family housing in marital crisis: a doctrinal and jurisprudential analysis

This document analyzes the allocation of the use of the family home in situations of marital crisis, based on Article 96 of the Spanish Civil Code. The criteria for allocation are examined, as well as the duration of the measure and the expenses related to the home. Several Supreme Court and of Justice of the European Union rulings related to the allocation of the use of the family home are analyzed, including cases involving children with disabilities and shared custody. Finally, reforms to Article 96 of the Civil Code are proposed, suggesting the implementation of financial compensation for the spouse who does not enjoy the use of the home, in order to avoid situations of injustice and reduce litigation. It is concluded that direct compensation is the fairest and most reliable instrument to end the absolute free use of the home.
