RETROSPECTIVE AND CHALLENGES FOR LAWYERS-MEDIATORS

Abstract

Thanks to the enactment of the state law on mediation on civil and commercial affairs in Spain and the imminent approval of its development rules, many lawyers and Bars first attend on mediation. Implementation of mediation is connected to reorganization to the Bar. The lawyers have developed an important role in the birth and evolution of ADR techniques. In facts, they contribute to mediation with accurate communicative, relational and ethical skills. The traditional role as representation in legal proceedings is relegated to the background in order to play new roles required by civil society. However, the lack of customers and fees in legal sector can ruin a transformative movement on social relations and peace culture establishment.
