Insolvency proceeding for a natural person married in community property

The institution of marriage involves an affective bonding in family, and it is built on a financial foundation. When two people decide to get married, a new legal reality is created giving birth to a matrimonial property regime. As far as finances and patrimony are concerned, marriage has unique features in the event of a declaration of insolvency by either of the spouses. This article aims to elucidate the effects of the community property regime on the insolvency proceedings of natural persons, which is a subject of major relevance in the wake of the Recast Text of the Insolvency Law, the transpose Directive (EU) 2019/2013, and the significant increase in insolvency proceedings in the wake of the COVID-19 pandemic.
