THE IMPACT OF INTERNATIONAL HUMAN RIGHTS IN DOMESTIC LAW: THE INTERPRETATION OF ARTICLE 10.2 OF THE SPANISH CONSTITUTION

Abstract

Article 10.2 of the Spanish Constitution requires that constitutional norms relative to fundamental rights be interpreted in conformity with the international treaties on those matters ratified by Spain. The proper interpretation of this interpretative criterion can help to expand the impact of the international law of human rights in the Spanish legal system. In order to promote this impact this paper aims to provide some guidelines for interpreting article 10.2.
