LEGAL-INSTITUTIONAL DIMENSION OF THE MERCOSUR: A PANORAMA TO ITS TWENTY YEARS

Abstract

The discussion about the legal and institutional design to be given to MERCOSUR was present from the beginning of the process. In its founding instrument –Treaty of Asuncion (1991)- it was decided to establish a minimal organizational structure, intergovernmental –like, in order to start the integration process. However, the implementation of de agreed policies led to development of a complex framework of subsidiary organs, involved in different areas of government and also the creation the of new organs. In addition, modifications were established in de incorporation and implementation of regional rules; and dispute settlement procedures. This article offers an assessment achieved during the 20 –year- old existence of Mercosur such as the introduction of some issues that are considered necessary to change.
