A commentary is made on a recent and interesting judgment of Supreme Court that analyses and resolves the revocation of a modal donation in wich the burden of caring for their parents is included for the son and donee. The judgment declares that the action of revocation was filed in time, even thought the judgment of the appealed sentence is confirmes, while the argument of the appeal and the dies a quo are dimissed. We analyze the deadline by which the revocation must be filed and whether the assumptions of non-compliance with the mode and revocation of the donation due to ingratitude are
met.
