From genes to memes. The specific case of law: a vision toward an integrative sociology of law

Abstract

approach supplies a new field of study for the Sociology of Right and studies concerning Right Doctrines. A memetic perspective of Right as a social construction is put forward and
the importance of Rights as macromemes is analyzed. Based on memetic theory, Rights are studied as an indispensable social response for the survival of the social group. New data
concerning the existence of a selective structure derived from ancestral biological patterns is included, this data has been published in several important journals after Retana-Salazar´s
postulation. These patterns are common to social groups in nature. Such data increases the amount of evidence which suggests that there is a strong tendency in natural social groups to develop internal rules that help to establish cooperative ties in favour of the social cohesion within the group. The French Civil Right´s Code, promulgated by Napoleon, is analyzed as a successful memetic structure with high socio-cultural heritability.
